Terms of Service

Agreement

These Terms of Service govern access to and use of ShiftSend, a software service for job application outreach. By creating an account, subscribing, buying credits, or using ShiftSend, you agree to these terms. ShiftSend is operated by Luca Aubry DeFilippo. Electronic acceptance and checkout records may be retained as evidence of your agreement.

Service description

ShiftSend helps job seekers find job leads, prepare application emails, track outreach, and manage daily sending limits. ShiftSend is not a staffing agency, recruiter, or employer.

Eligibility

You must be at least 14 years old and currently reside in Canada or the United States to create or use a ShiftSend account. You must provide an accurate birth month, birth year, country of residence, and search location. ShiftSend may reject locations outside supported countries. If applicable law requires permission from a parent, guardian, or payment-card holder, you must obtain it before using the service or subscribing.

No job guarantee

ShiftSend does not guarantee interviews, responses, employment offers, job placement, income, or hiring outcomes. Users are responsible for reviewing all applications and deciding where to apply.

Accounts and responsibility

  • You are responsible for keeping account credentials secure.
  • You must provide accurate account, billing, and contact information.
  • You are responsible for the documents, notes, preferences, and email text you submit or approve.
  • You must review application emails before approving them for sending.

User materials and email approval

You control the CVs, motivation letters, profile details, notes, preferences, revision instructions, and other materials you choose to upload, enter, or approve in ShiftSend. You are responsible for making sure those materials are accurate, appropriate, lawful, and that you have the right to use them.

Do not upload, submit, or approve content that is unlawful, misleading, discriminatory, harassing, explicit, infringing, confidential without authorization, or otherwise inappropriate. If ShiftSend drafts or sends an email using materials or instructions you provided and approved, you are responsible for the user-provided content in that email and for reviewing it before sending.

Acceptable use

  • Do not use ShiftSend to send spam, misleading messages, harassment, or unlawful content.
  • Do not attempt to bypass daily sending limits or payment restrictions.
  • Do not interfere with the service, scrape it, reverse engineer it, or misuse third-party integrations.
  • Do not upload content that you do not have the right to use.
  • ShiftSend may restrict or suspend accounts used for abusive, unlawful, deceptive, or unauthorized outreach.

Email sending and Gmail access

Users must connect only Gmail accounts they own or are authorized to use. ShiftSend may send application emails only after the user approves them. Users are responsible for reviewing email recipients, content, attachments, and sending choices before approval.

ShiftSend is intended for legitimate job application outreach. Users must not use the service for spam, bulk unsolicited marketing, deceptive messages, or any content that violates Gmail, Google, Stripe, or applicable law.

Users are responsible for complying with the consent, identification, privacy, opt-out, and electronic messaging rules that apply to their recipients and locations. A publicly listed email address does not by itself guarantee that every message is permitted. Users must respect recipient preferences and must not contact an address when they know or should know that the recipient does not want the message.

Application allowances and discarded drafts

An application counts toward the applicable free-trial or daily plan allowance when ShiftSend creates an email draft for a found recipient. The application remains counted whether the user later sends the draft or moves it to Trash.

Moving an email draft to Trash permanently removes it from the active review and sending workflow. It does not restore an application to the user's allowance, and ShiftSend does not find or provide a replacement email address or draft for that discarded application. Plan limits are maximum available capacity, not a guarantee that ShiftSend will find that number of suitable businesses or usable email addresses.

Contact data, generated content, and delivery

Business names, websites, addresses, and email addresses may come from public websites, mapping services, search results, or other third-party sources. ShiftSend does not guarantee that any found email address is legitimate, current, deliverable, controlled by the intended business, monitored for job applications, or appropriate for a particular application. A listed business may not be hiring or accepting applications. Users must review each recipient and business before approving an email.

AI-assisted drafts may contain mistakes, omissions, or unsuitable wording. Users are responsible for checking and correcting every draft, including its recipient, subject, message, personal information, and attachments. ShiftSend does not guarantee that an approved email will be delivered, avoid spam filtering, be read, receive a response, or reach the intended person. Delivery also depends on Gmail, recipient mail systems, internet access, and other third-party services outside ShiftSend's control.

Generated content is an automated suggestion, not professional, legal, employment, or factual advice. ShiftSend may use the workplace information, roles, preferences, availability, CV, motivation notes, prior revision instructions, and selected language supplied for the account to create a draft. Similar outputs may be produced for different users. Subject to third-party rights and applicable law, ShiftSend does not claim ownership of a user's original input or final edited application email. You grant ShiftSend a limited licence to host, process, reproduce, and transmit your content only as needed to provide, secure, and support the service.

Subscriptions, automatic renewal, and taxes

Each account includes three complete applications free without a payment card, and that free allowance does not automatically convert into a paid plan. Basic costs US$9.99 plus applicable tax every four weeks and includes up to 15 applications per day. Plus costs US$18.99 plus applicable tax every four weeks and includes up to 35 applications per day. Four-week billing results in up to 13 charges during a 52-week year; it is not calendar-month billing.

A paid plan automatically renews every four weeks at the disclosed price plus applicable tax until cancelled. Before checkout, ShiftSend displays the price, renewal frequency, cancellation method, and affirmative renewal authorization. Stripe processes payments and may collect billing-location information, calculate applicable taxes, authenticate the cardholder, issue receipts, and store the payment method for renewals. You must use a payment method you own or are authorized to use and provide accurate billing and tax-location information.

Cancellation, failed payments, and refunds

You may cancel online at any time through Settings, Billing, and the Stripe billing portal. Cancellation prevents the next renewal and normally remains effective through the end of the already-paid four-week period, unless the cancellation screen states otherwise. Deleting an account cancels the subscription immediately and removes access. You may also contact support if the portal is unavailable.

If a payment fails, Stripe may retry it and ask you to update or authenticate your payment method. ShiftSend may restrict paid features while a subscription is incomplete, past due, unpaid, cancelled, or otherwise inactive. Unless required by law, charges are non-refundable after a billing period begins. Nothing in these Terms limits a mandatory cancellation, cooling-off, refund, or consumer-protection right that applies where you live.

Account deletion and inactivity

You may permanently delete your account from Settings after reauthenticating. Deletion removes active profile data, preferences, leads, drafts, Gmail credentials, uploaded documents, and the ShiftSend authentication identity, and cancels any subscription. Limited payment, tax, fraud-prevention, dispute, security, and legal records may remain with ShiftSend or its processors where retention is required or permitted by law.

ShiftSend may delete an account and its service data after 24 consecutive months without account activity, provided it has no active, trialing, incomplete, or recoverable past-due subscription. A returning person must create a new account, accept the then-current terms, and complete setup again.

Third-party services

ShiftSend depends on third-party services that may include Google Maps and public websites for leads, Google Gmail for sending, Firebase for authentication, Google Cloud and AI services for hosting and drafting, Stripe for billing and tax functions, and recipient email systems. Their separate terms and privacy practices may apply. ShiftSend does not control and is not responsible for third-party availability, search results, address accuracy, authentication decisions, payment approvals, tax determinations, delivery, filtering, or outages.

ShiftSend intellectual property

ShiftSend's software, source and object code, workflows, visual interface, layout, design elements, documentation, databases, logos, product name, branding, and other original materials are owned by Luca Aubry DeFilippo or licensed to ShiftSend and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use the service for your own lawful job search. They do not transfer ownership or permit copying, reselling, sublicensing, scraping, circumventing safeguards, extracting source code, or creating a competing derivative service except where a restriction is prohibited by law.

Disclaimer of warranties

To the maximum extent permitted by applicable law, ShiftSend is provided "as is" and "as available." ShiftSend does not promise that the service will always be available, uninterrupted, secure, error-free, or suitable for every user's needs. ShiftSend makes no guarantee about the number or quality of leads, the legitimacy or deliverability of an email address, the accuracy or suitability of generated content, email delivery, employer responses, interviews, hiring, income, or any employment outcome.

These disclaimers do not exclude any express commitment made in these Terms or any warranty, condition, consumer guarantee, or other right that cannot lawfully be excluded. Some jurisdictions do not permit certain warranty disclaimers, so all or part of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by applicable law, ShiftSend is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost opportunities, profits, revenue, goodwill, or data, arising from or connected with the service, even if the possibility of that loss was known. ShiftSend is not responsible for losses caused solely by inaccurate user information, a user's failure to review a recipient or draft, unauthorized account use, recipient decisions, or third-party services outside ShiftSend's reasonable control.

Nothing in these Terms excludes or limits liability for intentional or gross fault, bodily or moral injury, ShiftSend's own acts where exclusion is prohibited, fraud, or any other liability or remedy that cannot legally be excluded or limited. Nothing in these Terms reduces mandatory privacy, data-protection, payment, refund, or consumer-protection rights available where you live.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Luca Aubry DeFilippo and ShiftSend harmless from third-party claims, damages, and reasonable costs, including reasonable legal fees, caused by your unlawful or fraudulent use of ShiftSend, content you submit without the necessary rights, infringement of another person's rights, deliberate misuse of a recipient's information, or a material breach of these Terms. This obligation applies only to the extent the claim was caused by your conduct and does not require you to indemnify ShiftSend for its own acts, fault, negligence, legal obligations, or matters for which indemnification is prohibited. ShiftSend will give reasonable notice of a covered claim and will not agree to a settlement that imposes a non-monetary obligation on you without your consent.

Suspension and termination rights

You may stop using ShiftSend at any time, cancel a subscription through the billing portal, and delete your account through Settings. Cancellation and deletion are subject to the billing, refund, deletion, and legally required retention provisions stated above.

ShiftSend may restrict, suspend, or terminate access for a material breach of these Terms, unlawful, abusive, deceptive, or unauthorized use, a credible security or safety risk, non-payment, fraud, or an attempt to evade safeguards or service limits. ShiftSend may act immediately when reasonably necessary to protect users, third parties, or the service. In other cases, and where legally required, ShiftSend will provide reasonable notice and an opportunity to address the issue. Any legally required refund or access to data will remain available.

Provisions that by their nature should continue after termination remain effective, including accrued payment obligations, intellectual property rights, lawful record retention, disclaimers, limitations of liability, indemnification, and dispute provisions.

Changes and availability

ShiftSend may change, suspend, or discontinue features, plans, limits, or pricing. We aim to keep the service available, but do not promise uninterrupted access. Material changes to subscription price or renewal terms apply only after legally required notice and consent. If part of these Terms is unenforceable, the rest remains effective. These Terms and referenced policies form the agreement concerning ShiftSend.

Governing law and dispute resolution

These Terms are governed by the laws of Québec and the applicable federal laws of Canada, without regard to conflict-of-law rules. This choice does not remove any mandatory consumer right, protection, jurisdiction, or remedy available under the law of your province, territory, state, or country of residence.

Before starting formal proceedings, you and ShiftSend agree to make a good-faith effort to resolve the dispute informally. Send a description of the issue and requested resolution to [email protected]. ShiftSend will attempt to respond within 30 days. This informal process does not prevent either party from seeking urgent relief, meeting a legal deadline, using an applicable small-claims process, or contacting a regulator or consumer-protection authority.

Unless mandatory law permits you to proceed elsewhere, unresolved disputes may be brought before the courts with jurisdiction in Québec. These Terms do not require pre-dispute arbitration and do not waive or restrict any right to go to court, bring or participate in a class action, or use another remedy protected by applicable law. After a dispute has arisen, the parties may voluntarily agree in writing to mediation or arbitration.
